Terms of Service

Plain English summary, which is not a substitute for the terms below but should match them: you pay monthly or yearly for a plan that includes usage credit. Your apps draw down that credit at published rates. If you are unhappy within 30 days, we refund you in full. You own your code and your data and can download it any time. Do not use NukeBase to break the law or to harm other people. Keep your own backup of anything you cannot afford to lose — we are not liable for lost data — and do not expect us to be liable for more than you paid us.

1. The agreement
These Terms are a contract between you and Anderson Web Consulting, a business registered in the State of Idaho, United States, which operates the NukeBase service ("NukeBase", "we", "us"). By creating an account or using the service you agree to them, along with our Privacy Policy, Acceptable Use Policy and, where it applies, Data Processing Addendum. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
You must be at least 16 years old.
2. Your account
- Your email address is your identity. We sign you in with a link rather than a password, so keep control of your inbox — anyone who can read your email can reach your account.
- You are responsible for everything that happens under your account.
- One person or organisation per account. Do not create multiple accounts to get around plan limits or a suspension.
- Tell us promptly if you think your account has been compromised.
3. Plans, credit and usage
NukeBase is sold as a plan that includes an amount of usage credit each month. Your projects consume that credit at the rates published on our pricing page, which form part of these Terms.
- Credit is added when your plan starts and on each renewal. On yearly plans it is added monthly rather than as a lump sum, and unused credit rolls forward.
- Usage is metered continuously — processor time, memory, disk, bandwidth, a per-project fee, a per-custom-domain fee, and sign-in emails beyond your plan's allowance.
- Credit has no cash value, is not transferable, and is not refundable except under section 5.
- If your balance reaches zero, your projects are paused rather than deleted. You can add funds, or enable auto-refill, to bring them back.
- Spend caps are available and we encourage you to set them. You remain responsible for usage your apps actually incur, including usage caused by your own code, a traffic spike, or a third party attacking your app.
We may change published rates or plan contents. We will give you at least 30 days' notice by email before an increase takes effect, and you may cancel before it does.
4. Payment
- Subscriptions are billed in advance, monthly or yearly, through Stripe. We do not see or store your card number.
- Prices are in US dollars and exclude any taxes, which we add where we are required to.
- Renewal is automatic until you cancel.
- If a payment fails we may retry it, and may pause your projects if it stays unpaid.
- Auto-refill, if you enable it, charges your saved card when your credit runs low. You can turn it off at any time in your dashboard.
5. Refunds and the 30-day guarantee
If you are not happy within 30 days of your first payment, email support@nukebase.com and we will refund that payment in full. No forms and no hoops.
After the first 30 days, payments are non-refundable except where the law requires otherwise, or where we have clearly failed to provide the service. If we cancel your plan for a reason that is not your fault, we refund the unused portion of the period you paid for.
If you are a consumer in the UK or EU, you have a statutory right to cancel a distance contract within 14 days. Because we start providing the service immediately, you accept that this begins at once and that if you cancel within the 14 days you may be charged for what you actually used. Our 30-day guarantee is more generous than the statutory minimum and does not replace your legal rights.
6. Cancellation and what happens next
- You can cancel any time from your dashboard. Your plan stays active until the end of the period you have already paid for.
- At the cancellation date, your projects stop running and a 30-day grace period begins. Resubscribe inside that window and everything comes back.
- After 30 days your projects are permanently deleted. Your account and any remaining credit balance stay.
- You can delete your account entirely at any time. Doing so cancels your subscription and removes your data as described in the Privacy Policy.
- Download your project before you cancel. We are not able to recover a project once the grace period has elapsed.
7. Your content and your users
- You own your code and your data. We claim no rights over them beyond the licence below.
- You grant us a limited licence to store, copy, transmit and display your content strictly as needed to run the service for you — for example to deploy it, back it up, or serve it to your users. The licence ends when you delete the content.
- You are responsible for what your applications do, what they collect, and for having your own privacy notice and legal basis for it.
- If your app handles other people's personal data, our Data Processing Addendum applies and you are the controller of that data.
- We may run backups, but you are responsible for keeping your own copy. Your dashboard lets you download your entire project at any time.
8. Acceptable use
Your use of NukeBase must comply with our Acceptable Use Policy, which is part of these Terms. In short: nothing illegal, no pornography or sexually explicit content, nothing designed to harm other people or systems, no mining cryptocurrency, no spam, and nothing that puts our infrastructure or our other customers at risk.
9. Availability
We work hard to keep NukeBase running, but we do not currently offer a contractual uptime guarantee or service credits. We may take the service down for maintenance, and will give notice where we reasonably can.
10. Suspension and termination by us
We may suspend or terminate your account if you materially breach these Terms or the Acceptable Use Policy, if your payments fail persistently, or if we must to protect the platform, other customers, or to comply with the law.
Where circumstances reasonably allow, we will warn you first and give you a chance to put it right. For serious cases — illegal content, attacks on others, activity that threatens the platform — we may act immediately. If we terminate your account for breach, you will not be refunded.
11. Intellectual property
NukeBase, its software, documentation and branding remain ours. Nothing here transfers our intellectual property to you. You may not resell, sublicense or white-label the platform itself without our written agreement — this does not stop you building and selling applications you host on it, which is exactly what NukeBase is for.
12. Disclaimers, data loss, and assumption of risk
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that data will never be lost.
Data loss
You accept the risk that data stored on NukeBase may be lost, corrupted, exposed or become temporarily or permanently unavailable. To the fullest extent the law allows, we are not liable for any such loss, including where it results from:
- unauthorised access to, or compromise of, our systems or a provider's systems, however caused;
- failure, outage, degradation or termination of a server, network, data centre or third-party provider we depend on;
- defects, errors or unintended behaviour in the NukeBase platform itself;
- defects, errors or unintended behaviour in your own code, configuration or security rules;
- deletion, whether by you, by someone using your account, or under the retention and cancellation rules in these Terms;
- events outside our reasonable control.
Backups are your responsibility
We take operational backups and some plans describe backup features, but we do not guarantee that any backup will exist, be complete, or be recoverable, and a backup feature is not a promise of recovery. Your dashboard lets you download your entire project at any time, and you are responsible for keeping your own independent copy of anything you cannot afford to lose. Do not rely on NukeBase as your only copy.
What we cannot exclude
Some jurisdictions do not allow these exclusions, in which case they apply only as far as the law permits. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for anything else that cannot lawfully be excluded. If you are a consumer, this section does not affect your statutory rights, and our obligation to provide the service with reasonable care and skill is not excluded.
Nothing in these Terms limits any right a data subject has under data protection law, or our obligations to them — those cannot be waived by contract between us and you.
13. Limitation of liability
To the fullest extent the law allows:
- Neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data.
- Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$100.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited. If you are a consumer, this section does not affect your statutory rights.
14. Indemnity
You agree to indemnify and hold us harmless from claims, damages and reasonable legal costs arising from your content, your applications, your use of the service, or your breach of these Terms — except to the extent the claim is caused by us.
15. Changes to these terms
We may update these Terms. For material changes we will email you at least 30 days beforehand, and continuing to use the service afterwards means you accept them. If you do not, you may cancel and we will refund the unused portion of your current period.
16. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, United States, without regard to its conflict-of-laws rules. The state and federal courts located in the State of Idaho have exclusive jurisdiction, and both parties consent to that venue.
Before filing anything, please email support@nukebase.com and give us 30 days to resolve it. Most problems are a misunderstanding and are cheaper for everyone to fix in an inbox.
If you are a consumer in the UK or EU, nothing in this section deprives you of the protection of the mandatory laws of the country you live in, or of your right to bring proceedings in your local courts.
17. General
- Entire agreement. These Terms, with the policies they reference, are the whole agreement between us.
- Severability. If a provision is unenforceable, the rest stays in force.
- No waiver. Not enforcing something once does not waive it.
- Assignment. You may not assign these Terms without our consent. We may assign them to a successor in a merger or sale.
- Force majeure. Neither party is liable for failures caused by events outside its reasonable control.
